The T Visa is a U.S. non-immigrant visa designed for victims of human trafficking. Its purpose is to protect undocumented immigrants who have been illegally smuggled into the U.S. in cases of:
Sex trafficking: When someone recruits, harbors, transports, provides, solicits, sponsors, or obtains a person for commercial sex acts; when the commercial sex act is induced by force, fraud, or coercion, or the person induced to engage in such acts is under the age of 18; or
Labor trafficking: When someone recruits, harbors, transports, provides, or obtains a person for labor or services through the use of force, fraud, or coercion for the purposes of involuntary servitude, peonage, debt bondage, or slavery.
With this visa, it is possible to work legally in the U.S. with an Employment Authorization Document (EAD).
After three years as a T Visa holder, it is also possible to apply for an adjustment of status to a Green Card, becoming a legal permanent resident.
– Be or have been a victim of a severe form of human trafficking as defined above;
– Be physically present in the United States, American Samoa, the Commonwealth of the Northern Mariana Islands, or at a port of entry due to trafficking;
– Cooperate with the investigations of the human trafficking process (unless you were under 18 years old at the time at least one of the trafficking acts occurred or cannot cooperate due to physical or psychological trauma);
– Demonstrate that you would suffer extreme hardship involving unusual and severe harm if you were to be removed from the United States; and
– Be admissible for permanent residence in the United States.
Family members of a human trafficking victim may be eligible for dependent visas and permission to stay in the United States. The categories include:
– T-2 Visa: for the spouse;
– T-3 Visa: for children;
– T-4 Visa: for parents (if the principal beneficiary is under 21 years old);
– T-5 Visa: for unmarried siblings under the age of 18 (if the principal beneficiary is under 21 years old).
